 These terms and conditions ("Agreement") governs the use of services ("service") that are made available by Docheal.com .The terms and conditions "Docheal", "we" , "us" , "company" and "our" refers to Docheal.com. These terms and conditions represent the whole agreement and understanding between Docheal.com and the individual or entity who subscribes to our services-"Health care providers", "you" ,"user" -  Duly qualified members of medical , dental and alternate medicine. - Labs - Chemist. "End-user", "you","user" – Patients / any person using website other than professional(s).

Please read this agreement carefully

by submitting your application & by your use of the service, you agree to comply with all the terms & conditions set out in this agreement. Docheal.com may terminate your account at any time , with or without notice , for conduct that is in breach of this agreement , for conduct that Docheal.com believes is harmful to its business or for conduct where the use of the service is harmful to any other party. If you have any questions about any part of the agreement, feel free to contact us at support@docheal.com.

Docheal.com may in its sole discretion can change or modify this agreement at any time, with or without notice. Such changes or modifications shall be made effective for all subscribers upon posting of the modified agreement to this web address (URL): https://www.docheal.com/returnsandrefunds. You are responsible to read this document from time to time to ensure that your use of the service remains in compliance with this agreement.

The agreement supersedes all previous oral and written terms and conditions

(if any ) communicated to you .

  1. Personal information:-

The website allows Docheal to collect information such as – Name, Age , E-mail , Phone.no , Address etc. for the purpose of communication & other services when required.

2.1)  Docheal shall not be held responsible in any manner for the authenticity of the personal information or the supplied information to Docheal or to any person acting on behalf of Docheal by the user.

2.2) By providing personal information to Docheal.com you consent us using that personal information carefully at its sole and absolute discretion , including for the purpose of providing promotional & marketing materials by other means.

2.3)  You warrant that you have obtained the consent of any third person whose personal information you post to the website.

2.4)  Our privacy policy available at www.docheal.com/privacy , sets out our privacy policy with respect to the collection, storage, use and transfer of any personal information.

2.5) By clicking ' I accept ' or ' I agree ' at the time of registration or providing personal information when required you are giving consent to our privacy policy.

  1. For End-Users:-

3.1)  The website allows you to get online consultations and appointments with health care providers based on the information you provide to Docheal com in the form of profile's of health care providers with the help of which you can choose accordingly to your suitability and proceed further.

3.2) You may also use the website to order lab tests from the certified labs that are associated with us. There will be home pick up facility available along with sending sample reports online of the tests done. You may book tests online and can personally visit the setup for sampling as per your convenience for those tests which require your physical presence such as radio-diagnostic procedures- X-ray, Ultrasound, M.R.I, C.T Scan, etc.

3.3)  The website allows you to order medicines from the pharmacies partnered with us. You can order medicine & can get it delivered at your doorstep accordingly to the facility available in your area. You have to upload the prescription for schedule 'X' class of drugs which appears as an appendix to the drugs & cosmetics rules 1945.

3.4)  Docheal is not responsible for any interaction between end-user and health care     provider. User understands and agrees that Docheal will not be liable for:-

  1. a) Any medical negligence on part of health care provider.
  2. b) Any issue arising while interaction of user with health care provider.
  3. c) Any misconduct by health care provider or its subordinates.

3.5) Docheal will levy an advance internet handling fee for each private interaction you have with health care provider through our website. We will also collect:-

a) Consultation fee payable to the health care provider in advance on behalf of health care provider.

b) Fee applicable for lab tests booked from our website with associated certified labs. For home sample pick up facility there will be extra charges for sample pick up.

c) Fee for medicines ordered through our website .Delivery charges to be paid extra than the billing of medicines.

  1. For health care providers:

4.1)  The website allows you to make profile after registration process that has the option of editing in later stage as per your requirement. The profile will be displayed on our website which enables the end-users to go through & book appointments & get online consultations.

For registration process you may be required to provide us with your credentials such as :-

  • Your photo Identity card
  • Your registration no. (MCI or State).
  • Your two passport size photographs.
  • Qualification & Experience.
  • Additional Qualification / Certification if any.

We may enquire to verify the authenticity of your information provided. You agree that we may terminate your account in case of failure of verification.

4.2) There will be registration process for labs also after which there profiles will be made online on our website. For registration process they need to give us credentials required as:-

a) Any registration certificate by governing body / agency required for their functioning or setup.

b) Photo identity card of the owner.

c) Two passport size photographs.

Only after the verification of the authenticity of credentials provided further usage of the website and its services will be allowed. End-users will be able to book tests provided by you on Docheal after your profile is made online. In case of failure of verification you agree that we may terminate your account.

4.3) The website allows pharmacies to get registered with our website. For registration process, required credentials are:-

  1. a) Registration no/ license by governing or affiliating body for operating a pharmacy business such as – retail drug licence (RDL) by central drugs standard control organisation and state drug standard control organisation.
  2. b) Photo identity card of the owner.
  3. c) Two passport size photographs.

After the verification of information provided End-user would be able to see your profile on our website and can order medicines using the services of our website. In case of failure of verification, you agree that your account will be terminated.

4.4) Health care providers may use the website to receive fee for their services to End-user where needed as per the guidelines issues by Docheal at the time of registration which will be settled down at the end of every month.

4.5) Health care provider can share their knowledge and information on the website in the section as provided by Docheal.com.

4.6) Responsibilities:

4.6.1) Health care provider shall promptly reply to the request of user after receiving communication i:e with a maximum of 3 hours if it is allocated to them without their acceptance and immediately  not delaying more than 5 minutes in case of accepting communication by their own choice.

Health care providers should treat online bookings and consultations as 'in-clinic' consultation & provide solution / advice to the best of knowledge.

4.6.2) In case where prescription is needed health care provider shall upload prescription written on letterhead & upload it in format possible or digitally.

4.6.3) It is the health care provider’s responsibility not to disclose the information given by the End-user at the time of communication.

4.6.4) In case where health care provider wants changes in the calendar and his status it should be done after completing current / open consultations. In case he is not in compliance to the above lines he shall be liable to pay such penalty as may be imposed by Docheal.

4.6.5) Health care provider understands that when an End-user books a time slot they must comply with it to the best of their availability. In case of delay or any changes it is the duty of the health care provider to notify End-user to their best possible ability.

4.6.6) Online consultation fee will be refunded in case of doctor advices that physical consultation in mandatory for assessing the condition of the End-user to reach out for accurate diagnosis.

4.6.7) In case health care provider needs to cancel the appointment or online consult allocated to them there will be refund to the End-user.

4.6.8) Health care provider shall not violate any applicable laws including MCI’s code of medical ethics regulations or any other code of conduct governed by the council. In case of violation of laws, Docheal holds no responsibility and is not liable for any proceedings by the governing council, as it is the sole responsibility of the health care provider to bind by the laws mentioned by governing council.

4.6.9) In case health care provider is found misusing the services of website or is not in compliance with the guidelines of these terms and conditions Docheal holds every right to terminate the account of health care provider & proceed with legalities if required or needed.

4.6.10) All refunds should be made at sole discretion of Docheal.

  1. Security:-

5.1) Docheal will not be held responsible due to any unauthorised use of your account as it’s your sole responsibility for maintaining the confidentiality of your account access information & password. In case of any unauthorised access to account user shall immediately notify Docheal. Although docheal will not be liable for your losses caused by an unauthorised use of your account.

5.2) Docheal assumes no responsibility towards damage & viruses that may infect user’s equipment on user’s access to, use of, or browsing the website or downloading any material, data, text, video, image, or audio content.

5.3) Docheal has the every right to suspend the account of user if information provided is found incorrect, incomplete, fraudulent or any kind of misbehave is seen on website.

  1. Third party websites:-

6.1) The website may contain links to third party information & products. Such content & links are not owned, operated or maintained by Docheal.com nor they are affiliated or associated with Docheal.com in any way, unless indicated on the external site.

6.2) If you decide to access any of the third party services or websites advertised or linked, you do so entirely at your own risk, as far as lawfully possible.Docheal.com accepts no liability or responsibility for the actions or omissions of users of the website or linked sites in relation to the content contained therein other than parties / partners associated with us for providing promotional & other benefits.

  1. Proprietary Rights:-

7.1) Intellectual property rights for the purpose of this terms of use shall always mean and include copyrights whether registered or not, patents including rights filing patents, trade names, trademark, designs, documentation, moral rights are protected by applicable intellectual property laws of India. The parties hereto agree and confirm that no part of any intellectual property rights mentioned herein above is transferred in the name of user and any intellectual property rights arising as a result of these presents shall also be in the absolute ownership, possession and our control.

7.2) Trademark, copyright and restriction:

 All material on this site, including images, illustrations, audio clips and video clips are protected by copyrights, trademark and other intellectual property rights. You must not copy, reproduce or republish, upload, post, distribute unless otherwise authorised in a written agreement, will constitute an infringement and may be actionable under the applicable laws.

  1. Limitation of liability:-

In no event will Docheal or its associates, subsidiaries or affiliates be liable for any special, incidental, indirect or consequential damages any loss of business, revenue, profits, arising under or relating to these terms of use. Not withstanding anything to the contrary in this agreement,  Docheal's maximum aggregate liability to you for any cause whatsoever and regardless of the form of action ( whether liability arises due to negligence, breach of contract, violation of  statue or for any other reason ) whatsoever will at all times be limited to INR FIVE HUNDRED ONLY (500).

  1. Indemnification:-

You agree to indemnify Docheal, it’s associates, representatives and other users and owners, employees & agents and to hold them harmless, from any all loses, damages, actions,  claims, and  liabilities and costs arising from your use or misuse of the website & its services or from your breach of the terms of use of the services. Docheal reserves the rights at your expenses, to assume the exclusive defence & control of any matter for which you are required to indemnify Docheal and you agree to co-operate with Docheal's defence & settlement of these claims.

  1. Role of Docheal:-

10.1) Docheal ’s role is that of an 'intermediary'. Docheal has no responsibility and/or liability in respect of the content on the website including End-user or healthcare provider. Thus not having the obligation to pre-screen or monitor the content at any time. However, Docheal in it’s sole discretion can monitor or remove End-user's and/or health care provider’s content, If  it is in violation of this agreement or any applicable laws & best practices.

10.2) In case of any illegal, fraudulent activity on the website by any End-user or health care provider Docheal reserves the right to inform the law enforcement authorities.

  1. Disclaimer:-

11.1) Consult in intended for general purposes only and is not meant to be used in emergencies.

11.2) However if any health care provider advises after online consult that physical examination is necessary it’s the sole responsibility of the user  to show up for 'in-person consultation' with the health care provider listed on the website or otherwise. Docheal holds no responsibility or is not held liable in case of any negligence on the part of the user in acting on the same & the condition of user deteriorates.

11.3) we expressly disclaim any liability for the consequences to you arising because of your use of the website & services.

  1. Cancellation Policy & Refund:-

12.1) In case there is cancellation of the appointment by health care provider there will be refund to the End-user. No refund in case of rescheduling of the appointment.

12.2) If there is cancellation from the side of End-user, refund will be given after deducting the cancellation charges applicable for that service.

12.3) After a refund is requested, the money will be refunded to the user in 7 working days from the day refund has been approved from Docheal.

  1. Dispute Settlement / Arbitration:-

13.1) You agree that this agreement and any contractual obligation b/w Docheal & user will be governed by the laws of India.

13.2) Any dispute, claim or controversy arising out of or relating to this notice or the breach, termination, enforcement, interpretation or validity thereof; including the determination of the scope or applicability of this agreement to arbitrate shall be determined by arbitration in India, before a sole arbitrator appointed by Docheal.  Arbitration shall be conducted in accordance with Arbitration and conciliation Act.1996, The seat of such arbitration shall be Chandigarh. The award shall be final & binding on the parties to the dispute.

13.3) Subject to the clause 13.2, the courts at Chandigarh shall have exclusive jurisdiction over any dispute arising out of or in relation to this agreement, your use of the website or it’s services or the information to which it gives access.
